Terms of Use

Please read these Terms of Use ("Terms") carefully before using the Ma Kyedie mobile application or website ("Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Acceptance of Terms

These Terms constitute a legally binding agreement between you and Ma Kyedie ("Company", "we", "us", "our"). By creating an account or using the Service in any way, you confirm that you are at least 13 years of age and have the legal capacity to enter into this agreement.

2. The MaKyedie Service

Ma Kyedie is a loyalty rewards platform that connects customers with participating local businesses in Ghana. The Service allows customers to earn and redeem points at partner businesses through QR code-based transactions. We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time.

3. User Accounts

• You must provide accurate and complete information when creating your account.
• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activities that occur under your account.
• Notify us immediately at support@makyedie.com if you suspect unauthorised access to your account.
• We reserve the right to suspend or terminate accounts that violate these Terms.

4. Points and Rewards

• Points are awarded based on eligible purchases at participating businesses and are subject to each business's points rate and terms.
• Points have no cash value and cannot be exchanged for cash, transferred to another account, or sold.
• Points expire after 3 months of inactivity at the relevant business (12 months for Hotel/Hospitality businesses).
• Rewards are subject to availability and may be changed or withdrawn by the relevant business at any time.
• We reserve the right to adjust, cancel, or expire points if we determine they were earned through fraudulent, erroneous, or abusive activity.
• The Company is not responsible for the quality, fulfilment, or availability of rewards offered by individual businesses.

5. Business Participants

Businesses that join Ma Kyedie agree to additional terms communicated at the time of registration, including:

• Honouring advertised rewards for customers who have met the required point thresholds.
• Accurate QR code usage and honest reporting of customer transactions.
• Payment of platform commissions as agreed at the time of registration.
• Compliance with applicable Ghanaian consumer protection and business laws.

We reserve the right to remove any business from the platform for non-compliance, fraud, or reputational harm.

6. Prohibited Conduct

You must not:

• Use the Service for any unlawful purpose or in violation of any applicable laws
• Attempt to earn points through fraudulent transactions or fake purchases
• Share, sell, or transfer your account or points to another person
• Reverse engineer, hack, or interfere with the Service or its underlying systems
• Use automated tools, bots, or scripts to interact with the Service
• Create multiple accounts to circumvent point limits or earn additional rewards
• Impersonate another person or misrepresent your affiliation with any entity

7. Intellectual Property

All content, branding, software, and materials within the Ma Kyedie app and website — including the logo, design, text, and functionality — are the intellectual property of Ma Kyedie and are protected by copyright and trademark law. You may not reproduce, distribute, or create derivative works without our express written permission.

8. Disclaimers and Limitation of Liability

The Service is provided on an "as is" and "as available" basis without warranties of any kind, express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or secure.

To the maximum extent permitted by Ghanaian law, MaKyedie shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of or inability to use the Service, including but not limited to loss of points, missed rewards, or data loss.

9. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, if you violate these Terms or for any other reason at our discretion. Upon termination, your points and rewards will be forfeited. You may also delete your account at any time through the app settings.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Ghana. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Ghana.
